Agreement to Terms

By accessing or using ConTrack ("Service"), you agree to be bound by these Terms of Service. If you don't agree to these terms, please don't use our service.

What ConTrack Does

ConTrack is a subcontractor management platform that helps contractors:

• Create and manage jobs
• Invite subcontractors via SMS
• Collect form submissions, photos, and signatures
• Track job progress and approvals
• Record payments and payouts

Account Requirements

• You must be at least 18 years old to use ConTrack
• You must provide accurate and complete information
• You're responsible for maintaining account security
• One person or business per account
• You must not share your account credentials

Subscription & Billing

Plans & Pricing

ConTrack offers subscription plans with different job limits and features. Current pricing is available at www.contrack-app.com.

Payment Terms

• Subscriptions are billed monthly or annually in advance
• All payments are processed securely through Stripe
• Prices are in USD unless otherwise stated
• You authorize us to charge your payment method automatically
• We may change pricing with 30 days' notice

Cancellation & Refunds

• You can cancel your subscription anytime
• Cancellation takes effect at the end of your current billing period
• No partial refunds for unused time
• You retain access until the end of your paid period
• Reactivation requires a new subscription

Acceptable Use

You agree NOT to:

• Use the service for any illegal purpose
• Send spam or unsolicited messages to subcontractors
• Harass, abuse, or harm others through the platform
• Upload malicious code or attempt to hack the service
• Scrape, copy, or reverse engineer our platform
• Impersonate others or provide false information
• Resell or redistribute the service
• Use the service to compete with ConTrack

Your Content

You retain ownership of all content you upload (job details, photos, forms, etc.). However:

• You grant us a license to store, process, and display your content to provide the service
• You're responsible for ensuring you have rights to all content you upload
• You must not upload content that violates others' rights or laws
• We may remove content that violates these terms
• You're responsible for backing up your data

Service Availability

We strive to provide reliable service, but we can't guarantee 100% uptime. We may:

• Perform maintenance that temporarily interrupts service
• Experience outages due to technical issues
• Modify or discontinue features with notice
• Suspend accounts that violate these terms

Limitations of Liability

To the maximum extent permitted by law:

• ConTrack is provided "as is" without warranties of any kind
• We're not responsible for data loss, business interruption, or indirect damages
• Our total liability is limited to the amount you paid in the past 12 months
• We're not liable for third-party services (Stripe, Twilio, etc.)
• You use the service at your own risk

Some jurisdictions don't allow liability limitations, so these may not apply to you.

Indemnification

You agree to indemnify and hold ConTrack harmless from any claims, damages, or expenses arising from your use of the service, violation of these terms, or violation of any rights of others.

Termination

We may suspend or terminate your account if:

• You violate these terms
• Your payment fails
• Your account is inactive for an extended period
• We're required to by law
• We discontinue the service

Upon termination, your access ends immediately. We'll retain your data according to our Privacy Policy.

Changes to Terms

We may update these terms from time to time. We'll notify you of significant changes via email or through the app. Continued use after changes means you accept the new terms.

Governing Law

These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of Arizona, US. You agree to submit to the jurisdiction of these courts.

Entire Agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and ConTrack. They supersede any prior agreements or understandings.
